Licence terms for user-generated content
Effective from 23 April 2026
1. Scope of the licence
By publishing content on the Platform (tips, photographs, texts, data, ratings, forum posts — hereinafter the „Content") the user (hereinafter the „Author") grants the Operator a royalty-free, non-exclusive, worldwide, time-unlimited (for the duration of copyright protection), transferable and sublicensable licence to use the Content to the extent necessary for the operation, promotion and development of the Platform, in particular for:
- Reproduction and storage on the servers of the Operator and its sub-processors.
- Making the Content available to other users of the Platform (Buyers).
- Use in marketing materials of the Platform (anonymously or with the Author's nickname — optional).
- Adaptation for technical purposes (compression, resizing, translation).
- Aggregate processing for analytics and training of internal models (e.g. tipster scoring, duplicate detection). Data is not provided to third parties for training AI models without separate consent.
2. Author's representations
The Author represents that:
- They are entitled to publish the Content and to grant the Operator a licence in the above scope — i.e. they are either the author or have the written consent of the author / rights holder.
- The Content does not infringe copyright, trademarks, personality rights, trade secrets or the right to protection of third parties' personal data.
- The Content is not misleading, unlawful, harassing or abusive.
- They have the consent of persons depicted in the photographs for the use of their likeness, where required (§ 84 of the Civil Code).
3. Liability for the Content
The Author alone is responsible for the lawfulness of the Content and its compliance with third-party rights. In the event that a third party asserts a claim against the Operator on account of Content published by the Author, the Author undertakes to settle such claims at their own cost or to compensate the Operator for any damage incurred, including reasonable costs of legal representation.
4. Content removal
The Operator is entitled to remove or disable access to the Content if it violates these terms, the Terms of Service, the Platform Rules or applicable law. The procedure for reporting unlawful content (notice-and-action) is described in the Content Moderation Policy.
Following the cancellation of the Author's account, the Operator will remove the Content from the public part of the Platform without undue delay, no later than within 30 days. Backups and audit logs may retain the Content for the time necessary to fulfil legal obligations (AML, accounting).
5. Duration of the licence
The licence lasts for the duration of copyright protection. Cancellation of the Author's account leads to the termination of further dissemination of the Content going forward; it does not automatically affect legitimate prior use (e.g. references in already-published marketing materials), whereby the Operator undertakes to limit such use to a reasonable extent.
