Tipster Terms

1. Introduction

These terms govern the special rights and obligations of users acting on the Platform as a Tipster (supplier of digital content). They supplement the Terms of Service, the Platform Rules and the Content Licence Terms.

2. Legal relationship with the Operator

The Tipster acts as an independent supplier of digital content. No employment relationship, commercial agency under § 2483 of the Civil Code, or employee relationship arises between the Tipster and the Operator. The Operator does not assign tasks to the Tipster; the Tipster decides alone which tips to publish, when and at what price.

3. Business status and tax obligations

The Tipster must assess themselves whether their activity on the Platform meets the criteria of business activity under § 420 of the Civil Code (continuity, independence, own responsibility, profit-making purpose). If so, they are responsible for obtaining the corresponding trade licence from the competent trade-licensing office.

The Tipster is also responsible for the correct taxation of their income (personal/corporate income tax, VAT, social security and health insurance) in accordance with applicable tax regulations.

Notice: The Operator is not a tax or legal adviser. For a correct assessment of legal status and tax regime we strongly recommend consulting a tax adviser, lawyer or the Tax Administration.

4. Identity verification (KYC)

  • Before the first tip publication, the Tipster must complete verification via Bank Identity.
  • Before the first FlipCoin payout, the Tipster must complete the KYC process in Stripe Connect (including bank account verification).
  • The Tipster will, upon request, provide the Operator with documents for enhanced identification (AML) where required by Act No. 253/2008 Coll. or by an internal risk score.
  • Providing false information during KYC is a material breach of the Terms and grounds for immediate account cancellation and blocking of the balance until the situation is clarified.

5. Tipster tiers, commissions and limits

On the Platform the Tipster is assigned to one of four tiers:

  • ROOKIE — entry tier; 30% commission; max. 3 active tips; escrow hold 7 days.
  • VERIFIED — 15% commission; max. 10 active tips; escrow hold 3 days.
  • EXPERT — 8% commission; max. 30 active tips; escrow hold 1 day.
  • ELITE — top tier; 3% commission; max. 100 active tips; no escrow hold.

Escrow hold is the period during which the reward from a sold tip remains in internal records before being released to the Tipster's balance; it serves to cover potential complaints and disputes.

The exact criteria for tier transitions and current limits are published in the Tipster Dashboard. The Operator is entitled to change the tiers, rates and limits with at least 30 days' prior notice.

6. FlipCoin payout (cash-out)

  • Minimum withdrawal amount: 1,000 FC (CZK 1,000).
  • 24-hour security delay: after submission of a withdrawal request, the amount is released for processing only after 24 hours for security reasons; during that time the request may be cancelled.
  • Escrow hold (0–7 days depending on the Tipster's tier at the time of sale) is calculated from individual transactions; only the balance for which the escrow period has already elapsed is available for withdrawal.
  • Payout is executed via Stripe Connect after successful KYC completion, typically within 3 working days of release from the 24-hour delay.
  • The Tipster is responsible for paying all related taxes and contributions (income tax, VAT, social and health insurance where applicable). The Operator does not withhold tax; upon request it will issue a transaction summary for tax purposes.
  • In case of a refund of a tip price to the Buyer (complaint, DSA removal), the corresponding amount is deducted from the Tipster's balance; if the balance is insufficient, the Tipster incurs a debt which must be paid within 14 days of request.

7. VAT

The Operator's service (commission) is a taxable supply with place of supply in the Czech Republic. If the Tipster becomes a VAT payer, they must notify the Operator without undue delay so that the Operator may issue tax documents in accordance with Act No. 235/2004 Coll. Until then, documents are issued as non-VAT-payer documents.

8. Prohibition of platform circumvention

  • The Tipster must not, for a period of 12 months from contact with a Buyer through the Platform, move the transaction concerning the same property off-platform with the aim of avoiding the commission (non-circumvention).
  • The Tipster must not systematically download, copy or export Buyer data for the purposes of a competing platform or marketing database.
  • In case of a proven breach of this prohibition by a Tipster who is an entrepreneur, the Operator is entitled to apply a contractual penalty of 2× the lost commission (minimum CZK 5,000) and compensation for proven damages. Against a Tipster who is not an entrepreneur (consumer), the contractual penalty does not apply; the Operator's right to compensation for proven damages is not affected.

9. Termination of Tipster activity

The Tipster may deactivate their profile at any time in the settings. Active tips will be withdrawn from sale within 24 hours; already-purchased tips remain permanently available to the Buyers under the licence granted at purchase.

The FC balance is paid to the bank account after expiry of open escrow periods and closure of open complaints, no later than within 30 days of deactivation, after deduction of proven claims.
